PLEASE READ THIS DISCLAIMER PRIOR TO USING OUR SERVICES. YOUR CONTINUED USE OF OUR SERVICES MEANS THAT YOU ARE AGREEING TO ALL THE TERMS AND LIMITATIONS IN THIS DISCLAIMER.
POSSESSIONS LEFT IN THE VEHICLE: Each customer should remove any belongings they consider to be of value before exiting their vehicle. Dr. Wash Car Wash is not responsible for any belongings that may be lost, stolen, damaged, or otherwise disposed of in the course of cleaning your vehicle.
INTELLIGENT CAR DISCLAIMER: Dr. Wash Car Wash puts vehicles in neutral gear during the machine wash cycle. If your vehicle changes that gear during the wash cycle, then you are solely responsible for any and all damage to your vehicle, the car wash equipment and harm to our employees related to your vehicle changing any gear, EVEN THOUGH SUCH DAMAGE IS CAUSED BY OR ALLEGED TO BE CAUSED BY OUR NEGLIGENT ACTS OR OMISSIONS.
DAMAGE: Any claims for damage or unsatisfactory service must be made prior to exiting the premises. We are not responsible for any damage to you or your vehicle that may occur while your vehicle is being vacuumed or washed or you are otherwise on our premises or using our facilities, and by using our facilities you assume all risks inherent in an automated car wash. Without limiting the foregoing, we are not responsible for any damage related to pre‐existing conditions (tears, scratches, dents, stains, odors, etc.) or accessories and components (automated windshield wiper systems, wiper blades, rear window wipers, loose interior trim or exterior moldings, exterior mirrors, trailer hitch caps, roof racks, power antennas, insignia, aftermarket accessories, magnetic signage, running boards, hood ornaments, or alloy, chrome or mag wheels, headlights, rear lamps, or reflectors, etc.). We are only responsible for damage that is directly caused by our equipment while your vehicle is being washed, so long as the damage (i) does not involve a pre-existing condition, accessory or component of your vehicle, (ii) does not arise out of your negligence or misconduct, or (iii) is not caused directly or indirectly by another customer’s actions.
LIMIT OF LIABILITY: Each time that you access or use our Services you signify that you have read, understand, and agree to be bound by these Terms. If you do not agree to any of these Terms you must discontinue using the Services.
REPAIR POLICY: Should your vehicle suffer damage directly caused by our equipment while your vehicle is being washed, so long as the damage (i) does not involve a pre-existing condition, accessory or component of your vehicle, (ii) does not arise out of your negligence or misconduct, or (ii) is not caused directly or indirectly by another customer’s actions, we will provide you with the contact information of a reputable auto body shop to have an estimate prepared and to repair the damage for which we agree we are responsible. Should you choose to obtain an estimate or repairs from a different body shop, we reserve the right to reimburse you only for the reasonable cost of the repairs for which we agree we are responsible.
